Wisconsin Minimum Wage Law
Authorizes the Wisconsin Department of Workforce Development (DWD) to set minimum wage rates; the DWD has set the state rate equal to the federal floor. The DWD investigates wage complaints; employees may recover unpaid wages plus equal liquidated damages in civil court within two years. Employers must maintain payroll records. Wisconsin has a youth minimum wage of $5.90 per hour for the first 90 days of employment for workers under 20.
Wisconsin Fair Employment Law (WFEA)
Prohibits employment discrimination based on age (40+), race, creed, color, disability, marital status, sex, national origin, ancestry, arrest or conviction record, military service, use or non-use of lawful products outside work, and declining to attend or participate in employer-sponsored meetings on religious or political matters. The Wisconsin Equal Rights Division (ERD) of the DWD investigates charges; employees must file within 300 days.
Wisconsin Wage Payment Act
Requires wages to be paid at least monthly; more frequent paydays are permitted. Final wages for separated employees must be paid on the next regular payday. Employees who are not paid timely may file complaints with the DWD or bring civil actions within two years to recover unpaid wages plus equal liquidated damages and attorney fees. The DWD may investigate, order payment, and assess civil penalties for non-compliance.
Wisconsin Personnel Records Access
Requires Wisconsin employers to provide employees and former employees access to their personnel records within seven working days of request. Employees may review and copy their records and challenge inaccurate entries. Employers must retain personnel records for at least three years after the date of the last entry. Failure to provide timely access is subject to a civil fine of $10 to $100 per day, recoverable by the employee.
