  • Public policy exception (Allen v. Safeway Stores): Wyoming recognizes a narrow common law exception to at-will employment when a termination violates a clear public policy of the state expressed in the Wyoming Constitution, statutes, or judicial decisions. Recognized grounds include retaliating against employees for filing workers' compensation claims (Wyo. Stat. § 27-14-311) and for jury service. Wyoming courts interpret the exception very narrowly and rarely expand it beyond established statutory rights.
  • Implied contract exception: Wyoming courts recognize that specific and definitive language in employee handbooks or oral representations by management can create implied employment contracts. The employer's language must constitute a clear offer of job security — not merely an aspirational statement about company values. At-will disclaimers are effective in Wyoming and should be included in all offer letters, handbooks, and employment-related documents.

$7.25/hr (eff. 2009-07-24)

Wyoming state minimum wage is $5.15 per hour under Wyo. Stat. § 27-4-202, but the federal FLSA minimum wage of $7.25 per hour supersedes this rate for covered employers. Most Wyoming employers are covered by the FLSA and must pay $7.25. The state rate of $5.15 applies only to the narrow category of Wyoming employers not covered by federal FLSA (typically very small, non-interstate businesses). A tipped employee rate of $2.13 per hour is permitted under the federal FLSA.

Wyo. Stat. § 27-4-202

Wyoming Minimum Wage Law

Sets the state minimum wage at $5.15 per hour for non-FLSA-covered employers. Most employers are covered by the federal FLSA minimum of $7.25. The Wyoming Department of Workforce Services investigates wage complaints for state law violations; federal FLSA claims go to the U.S. DOL. Employers must maintain payroll records and post applicable wage notices. The state rate has not changed since 2001.

Wyo. Stat. § 27-9-105

Wyoming Fair Employment Practices Act (WFEA)

Prohibits employment discrimination based on age (40+), sex, race, creed, color, national origin, and disability. Applies to employers with two or more employees — lower threshold than federal Title VII's 15-employee minimum. The Wyoming Department of Workforce Services processes complaints; employees must file within 180 days. Remedies include reinstatement, back pay, compensatory damages, and attorney fees. Sexual harassment is expressly covered under the sex discrimination prohibition.

Wyo. Stat. § 27-4-104

Wyoming Wage Payment Act

Requires wages to be paid at regular intervals. Final wages for separated employees must be paid within five working days of separation or on the next regular payday — whichever is earlier. Employers who fail to timely pay final wages face a civil penalty recoverable by the employee in district court. The Wyoming Department of Workforce Services investigates administrative complaints and may order payment of wages owed.

Wyoming Workers' Compensation Act

Requires Wyoming employers with one or more employees to participate in the state's mandatory workers' compensation program administered by the Wyoming Department of Workforce Services. Wyoming has a state fund for workers' compensation — private insurance for core Wyoming workers' compensation benefits is not available. Benefits include medical treatment, temporary disability payments, permanent partial and total disability awards, and death benefits.
