First National Bank): West Virginia recognizes a well-established wrongful discharge tort for violations of substantial public policy expressed in the West Virginia Constitution, statutes, or judicial decisions. Recognized grounds include retaliating against employees for filing workers' compensation claims, for jury service, for whistleblowing under the WV Employee Whistleblowing Protection Act (W. Va. Code § 6C-1-1), and for exercising rights under WV labor statutes.
  • Implied contract exception: West Virginia courts have recognized that specific language in employee handbooks establishing termination procedures or "good cause" standards can create implied employment contracts. The court examines the totality of the circumstances — including the handbook's overall tone, any at-will disclaimers, and the employee's acknowledgment. Employers should use conspicuous at-will disclaimers and obtain signed acknowledgments from all employees.

Minimum Wage

$8.75/hr (eff. 2016-01-01)

West Virginia minimum wage is $8.75 per hour under W. Va. Code § 21-5C-2, enacted in 2015. This rate is higher than the federal floor of $7.25 and has not been increased since 2016. A tipped employee rate of $2.62 per hour applies; total compensation must equal $8.75. WV does not have a mechanism for automatic increases; further changes require legislative action.

W. Va. Code § 21-5C-2

West Virginia Minimum Wage Law

Sets the statewide minimum wage at $8.75 per hour — above the federal floor. The West Virginia Division of Labor investigates wage complaints; employees may recover unpaid wages plus equal liquidated damages and attorney fees in civil actions within three years. Employers must post the current minimum wage notice and maintain payroll records. A tip credit of $2.62 per hour is permitted for tipped employees.

W. Va. Code § 5-11-9

West Virginia Human Rights Act

Prohibits employment discrimination based on race, religion, color, national origin, ancestry, sex, age (40+), blindness, and disability. Applies to employers with 12 or more employees. The West Virginia Human Rights Commission (WVHRC) investigates charges; employees must file within 365 days of the discriminatory act. Remedies include reinstatement, back pay, compensatory damages, civil fines up to $10,000, and attorney fees.

W. Va. Code § 21-5-3

West Virginia Wage Payment and Collection Act

Requires wages to be paid at regular intervals. Final wages for employees who are laid off or discharged must be paid on the next regular payday or within four business days — whichever comes first. Voluntary resignations require payment on the next regular payday. Employers who fail to pay timely face a civil penalty of 3x the unpaid wages as liquidated damages, plus attorney fees. The Division of Labor may investigate and assess civil penalties.

West Virginia Workers' Compensation Anti-Retaliation

Prohibits employers from discharging, laying off, or discriminating against any employee for attempting to receive or receiving workers' compensation benefits. Employees must file retaliation claims in circuit court within two years of the retaliatory act. Remedies include reinstatement, back pay, restoration of benefits, and compensatory damages. The employer bears the burden of proving the discharge was not related to the workers' compensation activity.
