  • Public policy exception: Nevada recognizes wrongful discharge claims when a termination violates a clear public policy expressed in the Nevada Constitution, statutes, or administrative regulations. Courts have recognized this exception in cases involving discharge for filing workers' compensation claims, for refusing to violate state law, or for exercising rights under Nevada wage payment statutes. The exception is recognized but interpreted narrowly.
  • Implied contract exception: Nevada courts recognize that specific language in employee handbooks or personnel manuals can create implied employment contracts. The court examines whether the employer's language constituted a definite offer of continued employment, whether it was communicated to the employee, and whether the employee accepted the terms by continuing work. Employers should include clear at-will disclaimers in all handbooks and signed acknowledgment forms.

Nevada minimum wage: as of July 1, 2024, Nevada has a single-tier minimum wage of $12.00 per hour for all employers. Prior law had a two-tier system based on whether employers provided qualifying health benefits. Annual CPI-indexed increases apply starting July 2024 under AB 456 (2021). The tip credit was eliminated in 2019; tipped employees must receive the full minimum wage regardless of gratuities.

NRS § 608.250

Nevada Minimum Wage

Establishes the statewide minimum wage with annual CPI adjustments beginning July 2024. Nevada eliminated the two-tier wage system in 2023, creating a single rate applicable to all employers. The Nevada Labor Commissioner enforces violations; employees may recover unpaid wages plus equal liquidated damages in civil actions within two years. The tip credit was eliminated; tipped employees must receive the full minimum wage before tips.

NRS § 608.0197

Nevada Paid Leave Law (SB 312)

Requires employers with 50 or more employees to provide paid leave accruing at approximately 40 hours per year. Leave may be used for any reason — the broadest permitted use standard in the country. Employees must have worked for the employer for 90 days before using accrued leave. Employers may cap accrual at 40 hours and front-load the annual amount as an alternative to tracking accrual. The Nevada Office of the Labor Commissioner enforces violations; remedies include back pay and reinstatement.

NRS § 613.330

Nevada Equal Opportunity in Employment

Prohibits employment discrimination based on race, color, religion, sex, sexual orientation, gender identity or expression, age (40+), disability, national origin, and pregnancy. Applies to employers with 15 or more employees. The Nevada Equal Rights Commission (NERC) investigates charges; employees must file within 300 days of the discriminatory act. NERC may conciliate or hold hearings. Remedies include reinstatement, back pay, compensatory damages, and attorney fees.

NRS § 608.040

Nevada Wage Payment on Termination

Requires that final wages for involuntarily discharged employees be paid immediately at the time of termination. Employees who resign with fewer than three days' notice must be paid within three days. Employees who provide three or more days' notice must be paid on the last day of work. Employers who fail to make timely final payment face a penalty of the employee's daily wages for each day of delay, up to 30 days. Private civil actions and Labor Commissioner complaints are both available.
