Minimum Wage

RSA § 279:21

New Hampshire Minimum Wage Law

The New Hampshire Department of Labor (NHDOL) investigates wage complaints; employees may recover unpaid wages plus liquidated damages in civil actions within three years. Employers must post the current minimum wage rate and maintain payroll records for three years.

RSA § 354-A:7

New Hampshire Law Against Discrimination

Prohibits employment discrimination based on age (18+), sex, race, creed, color, marital status, familial status, physical or mental disability, national origin, sexual orientation, and gender identity. Applies to employers with 6 or more employees. The New Hampshire Commission for Human Rights investigates charges; employees must file within 180 days. Remedies include reinstatement, back pay, compensatory damages, and attorney fees.

RSA § 275:43

New Hampshire Wage Payment Act

Requires wages to be paid weekly or bi-weekly (bi-monthly with written employee consent). Final wages for separated employees must be paid on the next regular payday or within 72 hours — whichever is earlier. The NHDOL may administratively investigate wage complaints and order payment. Employees may bring private civil actions within three years to recover unpaid wages plus equal liquidated damages and attorney fees.

RSA § 281-A

New Hampshire Workers' Compensation Act

Requires all employers with one or more employees to carry workers' compensation insurance or qualify as self-insured. Benefits include medical treatment, 60% of average weekly wages during disability (subject to state caps), permanent impairment awards, and death benefits.
