- Public policy exception: Nebraska recognizes wrongful discharge in violation of public policy when a termination contravenes a clearly established public policy expressed in the Nebraska Constitution, statutes, or regulations. Recognized examples include retaliating against employees for filing workers' compensation claims (Neb. Rev. Stat. § 48-1114), for jury service, or for exercising NLRA rights. The exception does not extend to general notions of fairness or equity.
- Implied contract exception: Nebraska courts recognize that specific and definite language in employee handbooks or personnel policies can create implied employment contracts. The court in Stanley v. Sherwood examines whether the language constituted a clear offer, whether the employee was aware of the offer, and whether the employee accepted by continuing employment. Employers should include conspicuous at-will disclaimers and have employees sign handbook acknowledgments.
Minimum Wage
$13.50/hr (eff. 2026-01-01)
Nebraska minimum wage reached $13.50 per hour in January 2026 as part of a voter-approved phased increase schedule under Initiative 433 (2022). The rate will increase to $15.00 per hour by January 1, 2026 in a final step. A tipped minimum wage of $2.13 per hour applies to tipped employees, with the requirement that total compensation including tips equals the state minimum wage.

Nebraska Wage and Hour Act
Sets the statewide minimum wage with scheduled increases. The Nebraska Department of Labor (NDOL) enforces violations; employees may recover unpaid wages plus liquidated damages in civil actions within three years. Employers must maintain time and pay records for at least three years. The NDOL also administers prevailing wage requirements for public works contracts and investigates child labor violations.
Nebraska Earned Sick and Safe Leave
Voter-approved initiative effective January 1, 2025, requiring all Nebraska employers to provide paid sick and safe leave. Coverage tiers based on employer size: 20+ employees = 56 hours/year paid; 10-19 employees = 40 hours/year paid; under 10 employees = 24 hours/year unpaid. Employees accrue at 1 hour per 30 hours worked. Permitted uses include own illness, family member care, domestic violence needs, and preventive medical care. The NDOL enforces violations.
Nebraska Fair Employment Practice Act (NFEPA)
Prohibits employment discrimination based on race, color, religion, sex, disability, national origin, marital status, pregnancy, and age (40+). Applies to employers with 15 or more employees. The Nebraska Equal Opportunity Commission (NEOC) processes complaints; employees must file within 300 days of the discriminatory act. NEOC may investigate, conciliate, and hold public hearings. Remedies include reinstatement, back pay, compensatory damages, and attorney fees.
Nebraska Wage Payment Act
Requires employers to pay wages at regular intervals not exceeding 31 days. Final wages for separated employees must be paid on the next regular payday or within two weeks — whichever is earlier. Employers who fail to pay within 30 days of an employee's written demand for wages face a civil penalty of 10% of the unpaid wages per year. Private civil actions may recover unpaid wages plus the penalty, court costs, and attorney fees within three years.
