Recognized grounds include retaliating against employees for filing workers' compensation claims, for whistleblowing under the Maine Whistleblowers' Protection Act (26 M.R.S.A. § 831), or for exercising rights under Maine labor statutes.
  • Implied contract exception: Maine courts have recognized that specific language in employee handbooks or oral representations by supervisors can create implied employment contracts that limit at-will rights. The court examines the totality of the circumstances — including the specificity of the promise, the extent of its communication to the employee, and whether consideration was given. Employers should include clear at-will disclaimers in all employment documents.

Minimum Wage

$14.65/hr (eff. 2026-01-01)

Maine minimum wage increases annually on January 1, indexed to CPI under LD 1609 (2017). The 2026 rate is $14.65 per hour. Portland and other municipalities may set higher local rates. Tip credit: employers of tipped employees may apply a credit up to 50% of the applicable minimum wage, provided total hourly compensation reaches the full minimum. Service employees in resort or seasonal businesses face different rates.

26 M.R.S.A. § 664

Maine Minimum Wage

Establishes the statewide minimum wage indexed to CPI with annual adjustments on January 1. Includes overtime requirements and exemptions consistent with FLSA. The Maine Department of Labor enforces violations; employees may recover unpaid wages plus 100% liquidated damages and attorney fees. Employers must post the current minimum wage notice and maintain payroll records for three years. The Department conducts annual surveys to set the following year's rate.

26 M.R.S.A. § 637

Maine Earned Employee Leave Law

Requires employers with 10 or more employees to provide earned paid leave at a rate of 1 hour per 40 hours worked, up to 40 hours annually. Uniquely, leave may be used for any reason — medical, personal, or otherwise — with only reasonable advance notice. Employers must provide written notice of the policy at hire and maintain leave balance records. The Maine DOL enforces violations; employees may recover unpaid leave plus penalties up to $1,000 per violation.

5 M.R.S.A. § 4572

Maine Human Rights Act (MHRA)

Prohibits employment discrimination based on race, color, sex, sexual orientation, gender identity, physical or mental disability, religion, ancestry, national origin, age, and familial status. Applies to all employers with one or more employees for most protected categories. The Maine Human Rights Commission investigates complaints; employees must file within 300 days of the discriminatory act. Remedies include reinstatement, back pay, compensatory damages, and attorney fees.

26 M.R.S.A. § 831

Maine Whistleblowers' Protection Act

Protects employees who in good faith report or refuse to participate in illegal activity by their employer. The Act is broadly written, covering reports to any appropriate authority — not limited to government agencies. Employees must file a complaint within 90 days of the retaliatory act with the Maine DOL or bring a civil action in Superior Court. Remedies include reinstatement, back pay, and compensatory damages including emotional distress.
