- Public policy exception: Maryland recognizes wrongful discharge in violation of clear public policies expressed in the Maryland Declaration of Rights, state statutes, or federal law. Recognized examples include terminating an employee for exercising rights under the workers' compensation statute, for reporting OSHA violations, for jury service, or for refusing to commit a crime. Courts limit the exception to situations where the public policy is specific and well-defined.
- Implied contract exception: Maryland courts recognize implied employment contracts arising from employee handbooks or oral representations that contain clear and specific promises of job security, progressive discipline requirements, or "cause" standards for termination. Employers can protect against implied contract claims by including conspicuous at-will disclaimers in handbooks, offer letters, and all employment agreements, and by obtaining signed acknowledgments.

Maryland minimum wage reached $15.00 per hour for most employers on January 1, 2024. Montgomery County and other Maryland jurisdictions have higher local rates. The statewide rate increases annually based on CPI beginning in 2025. A youth minimum wage of $12.00 per hour applies to employees under 18 for the first six months of employment. Tipped employees may be paid $3.63 per hour if their tips bring total compensation to $15.00.

Maryland Minimum Wage and Overtime Law
Sets the statewide minimum wage with annual CPI adjustments. Maryland overtime requirements generally track FLSA but may differ for certain industries. The Maryland Commissioner of Labor and Industry investigates wage complaints; employees may bring civil actions within three years to recover unpaid wages plus 2x liquidated damages and attorney fees. Employers must post wage notices in English and Spanish and maintain payroll records for three years.
Maryland Healthy Working Families Act
Requires employers with 15+ employees to provide paid earned sick and safe leave at 1 hour per 30 hours worked, capped at 40 hours annually. Accrued leave carries over, subject to the usage cap. Employers must provide written leave statements upon employee request. The Maryland Department of Labor (MDOL) enforces violations; prohibited retaliation against employees who use or request leave carries penalties of $500 to $2,000 per violation plus reinstatement and back pay.
Maryland Fair Employment Practices Act (MFEPA)
Prohibits employment discrimination based on race, color, religion, sex, age (18+), national origin, marital status, sexual orientation, gender identity, genetic information, disability, veteran status, and ancestry. Applies to employers with 15 or more employees. The Maryland Commission on Civil Rights (MCCR) processes complaints; employees must file within six months of the discriminatory act. Remedies include reinstatement, back pay, compensatory damages, civil penalties up to $300,000, and attorney fees.
Maryland Wage Payment and Collection Law
Requires wages to be paid at least twice per month at regular paydays. Final wages for terminated employees must be paid on or before the next regular payday; for voluntary resignations, on or before the next regular payday or within two weeks, whichever is earlier. Employees may recover up to 3x unpaid wages as a treble damages penalty for willful withholding. Employers face additional civil penalties from the MDOL Commissioner.
