  • Statutory exceptions only: Louisiana follows a strict interpretation of at-will employment under La. Civ. Code art. 2747 and does not recognize a broad common law public policy exception. The primary exceptions are created by statute: employees may not be discharged for filing a workers' compensation claim (La. R.S. § 23:1361), for jury duty service, or for exercising rights under specific statutes such as the Louisiana Environmental Whistleblower Act.
  • Implied contract exception: Louisiana courts rarely find implied contracts from employee handbooks or oral representations alone. The Louisiana Civil Code requires a "meeting of the minds" on essential contract terms; vague handbook language is typically insufficient to create binding employment guarantees. Clear and specific written agreements with definite duration and cause requirements can create an employment contract, but at-will status remains the strong default.

Louisiana has no state minimum wage statute; the federal FLSA minimum of $7.25 per hour applies. Louisiana law preempts local governments from enacting minimum wage ordinances higher than the federal rate under La. R.S. § 23:642. A failed 2024 ballot initiative sought a $15 minimum wage. Employers must comply with all federal FLSA posting and recordkeeping requirements.

La. R.S. § 23:631

Louisiana Wages Due on Separation

Requires employers to pay all earned wages within three days of discharge or resignation. If the employee is not paid within three days of demand, the employer owes a penalty equal to the employee's daily wages for up to 90 days, plus reasonable attorney fees. The Louisiana Workforce Commission may also investigate and collect unpaid wages administratively. This penalty provision is one of the most aggressive in the nation for wage payment delays.

La. R.S. § 23:302

Louisiana Employment Discrimination Law

Prohibits employment discrimination based on race, color, religion, sex, national origin, disability, sickle cell trait, and genetic information. Applies to employers with 20 or more employees. Employees must file charges with the Louisiana Commission on Human Rights within 180 days. Remedies include reinstatement, back pay, and compensatory damages. Notably, Louisiana does not include age or pregnancy as a protected characteristic under the state act — federal ADEA and PDA fill those gaps.

La. R.S. § 23:921

Louisiana Non-Compete Statute

Louisiana uniquely restricts non-compete agreements by statute (La. R.S. § 23:921). Such agreements are void as against public policy unless they are ancillary to an otherwise enforceable agreement, specify one or more parishes or municipalities where restrictions apply, and limit duration to no more than two years. Without specific geographic designations by parish, the agreement is unenforceable. Courts strictly interpret this statute and will not rewrite agreements to conform.

La. R.S. § 23:1361

Workers' Compensation Anti-Retaliation

Prohibits employers from discharging or otherwise discriminating against an employee for filing a workers' compensation claim or exercising rights under Louisiana's workers' compensation law. Employees must bring retaliation claims within one year of the adverse action. Successful claimants may recover reinstatement, back pay for lost wages, and reasonable attorney fees. Separate civil fines may be assessed against employers engaging in systemic retaliation.
