  • Public policy exception: Kentucky recognizes wrongful discharge claims when a termination violates a clear public policy of the Commonwealth expressed in the Kentucky Constitution, statutes, or administrative regulations. Recognized examples include retaliating against an employee for filing a workers' compensation claim (KRS § 342.197), for exercising rights under the Kentucky Wage and Hours Act, or for testifying at a legislative committee. Courts require the public policy to be specific and grounded in law.
  • Implied contract exception: Kentucky courts have held that definite and specific language in employee handbooks regarding termination procedures — such as descriptions of progressive discipline steps, "good cause" standards, or investigation rights before discharge — can create implied employment contracts. Employers should include clear at-will disclaimers, have employees sign handbook acknowledgment forms, and reserve the right to modify policies.

Minimum Wage

$7.25/hr (eff. 2009-07-24)

Kentucky minimum wage is $7.25 per hour, matching the federal floor. Kentucky law does not allow local governments to enact higher minimum wages; HB 87 (2014) preempts local wage ordinances statewide. A tip credit of $5.12 per hour applies to tipped employees who regularly receive more than $30 per month in tips, as long as total compensation equals at least $7.25.

KRS § 337.275

Kentucky Minimum Wage Act

Sets the statewide minimum wage at the federal floor. Exempt categories include agricultural workers, certain domestic service employees, and employees of certain small newspapers. The Kentucky Labor Cabinet enforces the Act; employees may recover unpaid wages plus an equal amount in liquidated damages in civil court or through an administrative complaint. Employers must post the current wage rate and maintain payroll records for three years.

KRS § 344.040

Kentucky Civil Rights Act

Prohibits employment discrimination based on race, color, religion, national origin, sex, age (40+), and disability. Applies to employers with eight or more employees. The Kentucky Commission on Human Rights (KCHR) investigates complaints; employees must file within 180 days of the discriminatory act. KCHR may conciliate, hold a hearing, and order remedies including reinstatement, back pay, compensatory damages, and attorney fees. Punitive damages are not available under the state Act.

KRS § 337.060

Kentucky Wages and Hours Act — Final Pay

Requires that wages for separated employees (both voluntary and involuntary) be paid no later than the next regular payday. An employer who refuses to pay all wages due within 14 days of demand faces a penalty equal to 100% of the unpaid wages, plus court costs and attorney fees. The Kentucky Labor Cabinet has authority to investigate wage payment complaints and issue civil citations with fines of $100-$1,000 per violation.

KRS § 342.197

Workers' Compensation — Anti-Retaliation

Prohibits employers from discharging, threatening, or otherwise discriminating against any employee for filing or attempting to file a workers' compensation claim, for exercising any right under Kentucky's workers' compensation statute, or for testifying in a workers' compensation proceeding. Retaliation claims must be filed with the Kentucky Labor Cabinet within one year of the adverse action. Remedies include reinstatement, back pay, restoration of benefits, and civil damages.
