Employers should include clear at-will disclaimers in all offer letters and handbooks to preserve at-will status and prevent implied contract claims.

Arizona minimum wage increases annually on January 1, indexed to CPI under Proposition 206 (Fair Wages and Healthy Families Act, 2016). The 2026 statewide rate is $14.35 per hour. Cities such as Flagstaff may set higher local rates. The tip credit is limited to $3.00 per hour for tipped employees who regularly receive more than $30/month in tips.

Key Arizona Employment Statutes
Arizona Minimum Wage Act (Prop 206)
Establishes the statewide minimum wage indexed to the CPI, preempting lower municipal rates while allowing higher local rates. Employers must post wage-rate notices and provide employees with pay stubs showing hours worked and wage rates. The Industrial Commission of Arizona enforces violations; employees may file complaints within one year or bring private civil actions within two years seeking unpaid wages, treble damages, attorney fees, and civil penalties.
Earned Paid Sick Time Act
Requires all private Arizona employers to provide paid sick time accruing at 1 hour per 30 hours worked. Permissible uses include the employee's own illness, caring for a family member, attending medical appointments, seeking help after domestic violence or sexual assault, and public health emergencies. Employers may not retaliate against employees who request or use earned sick time. The Industrial Commission investigates complaints within 90 days and may order reinstatement and triple damages.
Arizona Civil Rights Act
Prohibits employment discrimination based on race, color, religion, sex, national origin, age (40+), disability, familial status, and genetic information. Applies to employers with 15+ employees. The Arizona Civil Rights Division (ACRD) of the Attorney General's office investigates charges; employees must file within 180 days of the discriminatory act. Remedies include back pay, reinstatement, compensatory and punitive damages, and attorney fees.
Arizona Wage Payment Act
Mandates that wages be paid at least semi-monthly. Final wages for terminated employees must be paid within 3 business days of separation; for resignations with fewer than 5 days' notice, final pay is due on the next regular payday. Employees may bring private civil actions to recover unpaid wages plus treble damages as a penalty. The Labor Department may also investigate claims and assess civil penalties against employers who willfully withhold wages.
