These are narrow statutory protections, not a broad public policy doctrine as recognized in other states.
  • Implied contract exception: Arkansas courts have recognized that definitive language in employee handbooks regarding progressive discipline or "cause" requirements for termination can create implied employment contracts. Employers should include prominent at-will disclaimers — signed by each employee — to prevent handbook provisions from being interpreted as limiting termination rights.

Arkansas minimum wage reached $11.00 per hour on January 1, 2024 as the final step of a voter-approved schedule from Issue 5 (2018). The rate is not indexed to inflation; any future increases require legislative action or another ballot initiative. Employers with fewer than 4 employees are exempt from the state minimum wage; the federal $7.25 minimum applies to those employers.

Key Arkansas Employment Statutes

Ark. Code § 11-4-210

Arkansas Minimum Wage Act

Sets the statewide minimum wage for employers with four or more employees. Allows a tip credit of up to 50 cents per hour for tipped employees who earn enough in tips to bring total compensation to at least the minimum wage. Exempts agricultural workers, workers in amusement parks, and certain domestic service employees. The Arkansas Department of Labor investigates complaints; employees may recover back wages plus an equal amount in liquidated damages.

Ark. Code § 16-123-107

Arkansas Civil Rights Act of 1993

Prohibits employment discrimination based on race, color, religion, sex, national origin, and disability. Applies to employers with nine or more employees. Employees must file a complaint with the Arkansas Equal Employment Opportunity Agency within 180 days of the discriminatory act before pursuing civil litigation. Remedies include reinstatement, back pay, compensatory damages up to $100,000 depending on employer size, and attorney fees. Punitive damages are not available under the state act.

Ark. Code § 11-4-401

Arkansas Wage Payment Act

Governs wage payment frequency, requiring employers to pay wages at least semi-monthly. Final wages for terminated employees must be paid on the next regular payday. Employees may recover unpaid wages plus a penalty of two times the amount withheld in civil court. The Department of Labor may investigate complaints, issue payment orders, and assess civil penalties for willful non-payment.

Workers' Compensation — Anti-Retaliation

Prohibits employers from discharging or discriminating against any employee because the employee filed a workers' compensation claim, retained an attorney to pursue a claim, or testified in workers' compensation proceedings. This represents one of the few recognized exceptions to Arkansas's strong at-will doctrine. Employees have a two-year statute of limitations to bring retaliation claims; remedies include reinstatement, back pay, and compensatory damages.
