At-Will Status
At-will employment
2 exceptions
- Public policy exception: An employee may not be discharged for refusing to violate a statute, performing a public duty such as jury service, or exercising a protected statutory right. Alaska courts apply this exception narrowly, requiring the public policy to be clearly expressed in a constitutional provision, statute, or administrative regulation rather than inferred from general principles.
- Implied contract exception: Express or implied assurances of job security found in employee handbooks, offer letters, or oral representations can create enforceable employment contracts limiting at-will termination. Alaska courts examine whether a reasonable employee would interpret the employer's language as an intent to provide job security beyond the at-will default.
Minimum Wage
$11.91/hr (eff. 2026-01-01)
Alaska minimum wage adjusts annually on January 1 based on the Consumer Price Index for Anchorage. The 2026 rate is $11.91 per hour — significantly above the federal floor of $7.25. Key Alaska Employment Statutes
Alaska Minimum Wage Act
Establishes the statewide minimum wage, indexed to CPI since 2003. Exempt categories include agricultural workers, fishing operations, certain domestic service employees, and bona fide outside salespersons. Employers must post the current wage rate conspicuously and retain time-and-pay records for three years. The Alaska Department of Labor and Workforce Development (DOLWD) enforces violations and may assess civil penalties and recover back wages on behalf of employees.
Alaska Human Rights Law
Prohibits employment discrimination based on race, religion, color, national origin, age, physical or mental disability, sex, marital status, changes in marital status, pregnancy, and parenthood. Applies to employers with one or more employees — broader coverage than federal Title VII. The Alaska State Commission for Human Rights investigates complaints, conducts hearings, and may order reinstatement, back pay up to two years, and compensatory damages. Administrative exhaustion is required before civil suit.
Alaska Workers' Compensation Act
Requires all employers with at least one employee to carry workers' compensation insurance or qualify as an approved self-insurer. Provides the exclusive remedy for work-related injuries, replacing tort liability. Benefits include full medical treatment, wage replacement at 80% of the employee's spendable weekly wage, permanent impairment ratings, and vocational rehabilitation services. Willful failure to secure coverage is a Class B felony punishable by up to 10 years imprisonment.
Wage Payment and Collection Act
Requires wages to be paid at regular intervals not exceeding 15 calendar days. Upon involuntary termination, final wages must be paid within three working days; voluntary resignations require payment on the next regular payday. Employers who withhold wages without justification face a penalty equal to the greater of 10% of unpaid wages per day or the employee's daily wage rate. The DOLWD may file civil actions to recover unpaid wages and penalties on behalf of employees.
