- Public policy exception: Alabama courts recognize a narrow exception to at-will employment when a termination violates a clear public policy expressed in the Alabama Constitution, state statutes, or administrative regulations. Courts have applied this exception in limited circumstances such as discharging an employee for filing a workers' compensation claim (Ala. Code § 25-5-11.1) or for refusing to commit perjury.
- Implied contract exception: Specific promises or representations in an employee handbook, personnel manual, or oral statements by a hiring manager may create an implied employment contract that limits the employer's right to terminate at will. Alabama courts examine whether the employer's language was sufficiently definite and whether the employee reasonably relied on it as a promise of continued employment.

Workers' Compensation Retaliation
Prohibits employers from discharging, threatening, or otherwise discriminating against employees solely because they filed a workers' compensation claim or testified in a workers' compensation proceeding. This statute is the primary statutory exception to Alabama's at-will employment doctrine and the most frequently litigated state employment claim. Employees must file suit within two years of the retaliatory act. Remedies include reinstatement, back pay, and compensatory damages.
Alabama Workers' Compensation Act
Requires employers with five or more employees to carry workers' compensation insurance or be an approved self-insurer. Provides the exclusive remedy for work-related injuries and occupational diseases, replacing tort claims against the employer. Benefits include all reasonable medical treatment, temporary total disability at two-thirds of the average weekly wage (capped), permanent disability ratings, and death benefits to dependents. Employers with fewer than five employees are exempt but remain subject to negligence suits.
Alabama Employment Contracts Act
Governs the enforceability of non-compete and non-solicitation agreements in Alabama. Non-compete agreements must be in writing, supported by adequate consideration, and reasonably limited in time (up to two years) and geographic scope. Courts will reform overbroad agreements to enforce them within reasonable limits rather than void them entirely. Agreements protecting trade secrets and confidential information receive stronger judicial enforcement.
Alabama Unemployment Compensation Act
Establishes the state unemployment insurance program, funded by employer payroll taxes. Employees discharged through no fault of their own are generally eligible for benefits; those terminated for misconduct connected to work are disqualified. Employers who contest claims must respond to ADOL notices within prescribed deadlines or lose protest rights. Weekly benefit amounts range from $45 to $275 and may extend up to 14-26 weeks depending on economic conditions.
