- Public policy exception: Vermont courts recognize wrongful discharge claims when an employee is terminated for reasons that violate a clear expression of public policy found in the Vermont Constitution, state statutes, or administrative regulations. Recognized grounds include retaliating against an employee for filing a workers' compensation claim, for whistleblowing under 21 V.S.A. § 507, for jury service, and for exercising rights under other Vermont labor statutes. Courts require the public policy to be specifically articulable.
- Implied contract exception: Vermont courts have held that specific and unambiguous promises in employee handbooks or oral representations by supervisors can create implied employment contracts that limit at-will termination. Courts examine whether the employer's language constituted a clear and definite promise of job security and whether the employee reasonably relied upon it. Employers should include at-will disclaimers in all handbooks and have employees sign acknowledgment forms.
Minimum Wage

Vermont minimum wage increases annually on January 1, indexed to CPI under Act 91 (2014). The 2026 rate is $13.67 per hour. Vermont does not permit a sub-minimum wage for tipped employees — all employees must receive the full minimum wage regardless of gratuities. Cities and towns may not enact higher local minimum wages under Vermont law.

Vermont Minimum Wage Law
Establishes the statewide minimum wage with annual CPI-indexed adjustments on January 1. Vermont does not permit a tipped employee sub-minimum wage — all employees, including tipped workers, must receive the full state minimum wage. The Vermont Department of Labor (VDOL) enforces violations; employees may recover unpaid wages plus equal liquidated damages and attorney fees in civil actions within three years. Employers must post the current wage notice in a conspicuous location.
Vermont Earned Sick Time Act
Requires employers with 6+ employees to provide paid earned sick time accruing at 1 hour per 52 hours worked, up to 40 hours per year. Eligible uses include an employee's own illness or preventive care, care for a qualifying family member, and assistance with domestic violence needs. Employers must provide written notice of rights at hire and display the VDOL sick time poster. The VDOL investigates violations; retaliation against employees for using sick time carries civil penalties and employee back pay remedies.
Vermont Fair Employment Practices Act (VFEPA)
Prohibits employment discrimination based on race, color, religion, ancestry, place of birth, sex, sexual orientation, gender identity, age (18+), disability, HIV status, and genetic information. Applies to all employers with one or more employees. The Vermont Human Rights Commission (VHRC) processes complaints; employees must file within one year of the discriminatory act. Remedies include reinstatement, back pay, compensatory damages, civil penalties up to $10,000, and attorney fees.
Vermont Whistleblowers' Protection
Protects employees from retaliation for reporting to a supervisor or public body information about activities, policies, or practices the employee reasonably believes violate state or federal law. Protection applies to both internal reports and external complaints to regulatory agencies. Employees who experience retaliation must file a complaint with the VDOL within 90 days. Remedies include reinstatement, back pay, and compensatory damages for emotional distress.
