  • Public policy exception: Utah recognizes a narrow wrongful discharge claim when a termination violates a clear and significant public policy articulated in the Utah Constitution, state statutes, or judicial decisions. The Utah Supreme Court recognized this exception in Hansen v. America Online. Recognized examples include retaliation for workers' compensation claims, for jury duty service, and for exercising rights under specific Utah employment statutes. Courts do not extend the exception to general equitable or moral considerations.
  • Implied contract exception: Utah courts recognize that specific, unequivocal language in employee handbooks — particularly provisions establishing "cause" requirements or specific termination procedures — can create implied employment contracts. Courts examine whether the employee reasonably relied on the employer's representations. Utah Code § 34-28-17 was enacted to make at-will disclaimers more effective; signed acknowledgments are critical.

Minimum Wage

$7.25/hr (eff. 2009-07-24)

Utah minimum wage is $7.25 per hour, equal to the federal floor. Utah does not allow local minimum wage ordinances. Utah Code § 34-40-201 ties the state rate to the federal rate. A tipped employee rate of $2.13 per hour is permitted under the federal FLSA tip credit; total compensation must reach $7.25. Utah has no mechanism for state-level minimum wage increases separate from federal action.

Utah Code § 34-40-201

Utah Minimum Wage Act

Sets the state minimum wage equal to the federal rate. The Utah Labor Commission enforces violations; employees may recover unpaid wages plus an equal amount in liquidated damages in civil actions within three years. Employers must post the current minimum wage notice and maintain payroll records. Utah law does not provide for higher local wages; the state rate is the floor for all Utah employers.

Utah Code § 34A-5-106

Utah Antidiscrimination Act

Prohibits employment discrimination based on race, color, sex, pregnancy, childbirth, age (40+), religion, national origin, disability, sexual orientation, and gender identity. Applies to employers with 15 or more employees. The Utah Antidiscrimination and Labor Division (UALD) investigates charges; employees must file within 180 days. Remedies include reinstatement, back pay, compensatory damages up to $50,000 (notably lower than federal Title VII caps), and attorney fees.

Utah Code § 34-28-3

Utah Payment of Wages Act

Requires wages to be paid at least semi-monthly. Final wages for separated employees must be paid within 24 hours of termination for involuntary discharge, or by the next regular payday for voluntary resignations. Employers who fail to pay within 10 days of a written demand face a civil penalty of 10% of the unpaid amount per month, up to a total of the unpaid wages. Employees may bring civil actions within three years.

Utah Code § 34A-2-101

Utah Workers' Compensation Act

Requires employers with one or more employees to carry workers' compensation insurance or qualify as self-insured. Benefits include all reasonable medical expenses, temporary disability at 66-2/3% of average weekly wages (subject to state maximums), permanent impairment ratings, and death benefits. The Utah Labor Commission administers the program. Failure to carry required insurance results in personal employer liability for injuries plus penalties up to $1,000 per day.
