- Public policy exception: Oregon recognizes wrongful discharge claims when a termination violates a clearly established public policy expressed in Oregon Constitution, statutes, or regulations. Courts have recognized the exception for retaliating against employees for filing workers' compensation claims, for reporting OSHA violations, for jury duty service, and for exercising rights under Oregon family leave laws. The public policy must be specific and well-defined rather than inferred from general principles.
- Implied contract exception: Oregon courts recognize implied employment contracts from specific handbook language or oral representations creating definite expectations of continued employment. Oregon applies a totality of the circumstances test, examining the handbook language in context. At-will disclaimers are effective but must be written in a way that is clearly communicated to employees. Employers should obtain signed acknowledgments from all employees.
Minimum Wage
$14.70/hr (eff. 2024-07-01)
Oregon has a tiered minimum wage system: Portland Metro area ($16.45 in July 2024), Standard rate ($14.70), and rural/nonurban counties ($13.70). All rates adjust annually on July 1. Portland city may set additional higher local rates. No sub-minimum wage for tipped employees — all employees receive the full applicable minimum wage. Employers must determine which tier applies to each worksite.

Key Oregon Employment Statutes
Oregon Minimum Wage Act
Establishes a three-tier minimum wage structure based on geographic location, with annual July 1 increases. The Oregon Bureau of Labor and Industries (BOLI) enforces violations. Employees may recover unpaid wages plus equal liquidated damages plus attorney fees in civil actions within two years. Employers must post the applicable wage notice for their location and maintain payroll records for three years.
Oregon Sick Time Law
Requires employers with 10+ employees to provide paid sick leave accruing at 1 hour per 30 hours worked, up to 40 hours annually. Employers with fewer than 10 employees must provide unpaid sick time. Permitted uses include own illness, family member care, domestic violence and sexual assault needs, bereavement, and public health emergencies. BOLI enforces violations; retaliation carries civil penalties of $1,000 to $2,000 per violation plus reinstatement and back pay.
Oregon Unlawful Employment Practices
Prohibits employment discrimination based on race, color, religion, sex, sexual orientation, gender identity, national origin, marital status, age (18+), disability, family status, pregnancy-related conditions, and expunged juvenile records. Applies to employers with one or more employees. Employees must file complaints with BOLI within one year of the discriminatory act. BOLI investigates; remedies include reinstatement, back pay, compensatory damages, and attorney fees.
Oregon Wage Payment on Discharge
Requires that wages of discharged employees be paid immediately upon termination. For voluntary resignations with 48 hours' notice, final pay is due on the last day of work. For resignations without notice, final pay is due within 5 business days. Failure to timely pay triggers penalty wages equal to 8 hours of the employee's regular rate per day, up to 30 days. Private civil actions and BOLI complaints are both available.
