At-Will Status
At-will employment
2 exceptions
- Public policy exception: Oklahoma courts recognize a narrow exception to at-will employment when a discharge violates a clearly defined public policy expressed in the Oklahoma Constitution, state statutes, or federal law. Recognized grounds include retaliating against an employee for filing a workers' compensation claim (85A O.S. § 7), for jury service (38 O.S. § 34), or for exercising rights under Oklahoma employment statutes. Courts strictly limit the exception to specific statutory protections.
- Implied contract exception: Oklahoma courts have recognized that specific handbook language creating definite promises of job security or establishing procedural rights before termination can create implied employment contracts. Courts apply the Burk v. K-Mart test examining whether the employer made a clear and unambiguous promise and whether the employee reasonably relied on it. Employers should use conspicuous at-will disclaimers and signed acknowledgments in all employment documents.
Minimum Wage
$7.25/hr (eff. 2009-07-24)
Oklahoma minimum wage is $7.25 per hour, matching the federal FLSA floor under 40 O.S. § 197.2. Oklahoma has enacted a statutory preemption preventing cities and counties from setting higher local minimum wages. A tip credit of $5.12 per hour applies; tipped employees must receive at least $2.13 per hour, with total compensation reaching $7.25.

Key Oklahoma Employment Statutes
Oklahoma Minimum Wage Act
Sets the state minimum wage equal to the federal rate and allows a tip credit for tipped employees. The Oklahoma Department of Labor investigates wage complaints; employees may recover unpaid wages plus equal liquidated damages in civil court within two years. Employers must post the current minimum wage notice and maintain payroll records. Local governments are preempted from enacting higher minimum wages.
Oklahoma Anti-Discrimination Act
Prohibits employment discrimination based on race, color, religion, sex, national origin, age (40+), and disability. Applies to employers with 15 or more employees. The Oklahoma Human Rights Commission (OHRC) investigates charges; employees must file within 180 days of the discriminatory act. The OHRC may investigate, conciliate, and refer cases to the AG. Remedies include reinstatement, back pay, compensatory damages up to $300,000, and attorney fees.
Oklahoma Wage Payment Act
Requires wages to be paid at least semi-monthly. Final wages for separated employees must be paid on the next regular payday. Employers who fail to pay within that deadline face an additional civil penalty equal to 2% of the unpaid wages per day, up to 60 days. Employees may bring civil actions to recover unpaid wages plus the penalty and attorney fees. The Oklahoma DOL also investigates administrative complaints.
Oklahoma Workers' Compensation Code — Anti-Retaliation
Prohibits employers from discriminating against employees who file workers' compensation claims or exercise any rights under Oklahoma's Workers' Compensation Code. Retaliation is an independent tort claim cognizable in district court. Employees must file within 90 days of the retaliatory act — one of the shortest filing deadlines for employment claims in the nation. Remedies include reinstatement, back pay, compensatory damages, and attorney fees.
