- Public policy exception: Delaware courts recognize wrongful discharge when termination contravenes a clearly established public policy expressed in the Delaware Constitution, statutes, or case law. Examples include firing an employee for filing a workers' compensation claim, reporting environmental violations, or refusing to participate in conduct that would violate federal or state law. The public policy must be sufficiently specific and clearly defined rather than general societal norms.
- Implied contract exception: Specific language in employee handbooks or personnel manuals that establishes disciplinary procedures or grounds for termination can override the default at-will relationship. Delaware courts examine whether a reasonable employee would have interpreted the handbook language as creating binding obligations on the employer, and whether the employee provided consideration beyond continued employment in exchange for those promises.

Delaware minimum wage reached $15.00 per hour on January 1, 2025 as the final step of a multi-year phase-in schedule under SB 15 (2021). The rate is not currently indexed to inflation; future adjustments require legislative action. Delaware does not allow a sub-minimum wage for tipped employees — all employees must receive the full minimum wage regardless of tips.

Delaware Wage Payment and Collection Act
Requires employers to pay wages at least monthly or upon each regular payday. Final wages for terminated employees must be paid on or before the next regular payday, or within 30 days of the last day of employment — whichever is later. Employees may file administrative complaints with the Delaware Department of Labor (DDOL) or bring private civil actions to recover unpaid wages plus up to 2x liquidated damages and attorney fees within three years.
Delaware Discrimination in Employment Act (DDEA)
Prohibits employment discrimination based on race, marital status, genetic information, color, age (40+), religion, sex, sexual orientation, gender identity, national origin, disability, and veteran status. Applies to employers with 4 or more employees — lower threshold than federal law. The DDOL Office of Anti-Discrimination processes charges; employees must file within 120 days of the discriminatory act. Remedies include reinstatement, back pay, compensatory damages, and attorney fees.
Healthy Delaware Families Act (Paid Sick Leave)
Requires employers with 10+ employees to provide paid sick and safe leave accruing at 1 hour per 30 hours worked, up to 40 hours annually. The law covers employees working at least 90 days. Permitted uses include personal illness, family care, domestic violence, and public health emergencies. The DDOL enforces violations; retaliation against employees who use or request sick leave is subject to civil penalties of $1,000 per violation, plus employee remedies of back pay and reinstatement.
Delaware Workers' Compensation Act
Requires all Delaware employers to carry workers' compensation insurance covering all employees, including part-time, seasonal, and temporary workers. Benefits include 100% of reasonable medical expenses, two-thirds of average weekly wages during disability (subject to state caps), permanent impairment awards, and death benefits. Employers who fail to secure coverage face fines up to $10,000, personal liability for injured workers' claims, and potential criminal penalties for willful non-compliance.
