- Public policy exception (limited): Tennessee recognizes a narrow wrongful discharge claim under the Tennessee Public Protection Act (TPPA) when an employee is terminated for refusing to participate in or for reporting illegal activity. The TPPA requires that the employee's refusal or report be based on a reasonable belief that the activity violates law. Courts have also recognized exceptions for discharge related to workers' compensation claims under Tenn. Code § 50-6-114.
- Implied contract exception: Tennessee courts may find implied employment contracts from sufficiently specific handbook language, but require a high degree of specificity — vague procedural descriptions do not suffice. At-will disclaimers are highly effective in Tennessee and courts generally enforce them even when coexisting handbook language might otherwise suggest a different interpretation.

Tennessee has no state minimum wage; the federal FLSA minimum of $7.25 per hour applies. Tennessee law does not allow local minimum wage ordinances. A federal tip credit of $5.12 per hour is permitted; tipped employees must receive at least $2.13 per hour with total compensation equaling $7.25. No state mechanism exists for minimum wage increases separate from federal congressional action.

Key Tennessee Employment Statutes
Tennessee Wage Regulation Act
Requires wages to be paid at regular payroll intervals and mandates that employers notify employees of paydays and wage rates. Final wages for separated employees must be paid on the next regular payday or within 21 days of separation, whichever is earlier. Employees who are not paid timely may file complaints with the Tennessee Department of Labor and Workforce Development or bring civil actions within three years to recover unpaid wages plus liquidated damages.
Tennessee Human Rights Act (THRA)
Prohibits employment discrimination based on race, creed, color, religion, sex, age (40+), national origin, and disability. Applies to employers with eight or more employees. The Tennessee Human Rights Commission (THRC) investigates charges; employees must file within 180 days of the discriminatory act. THRC may conciliate, hold hearings, and issue cease-and-desist orders. Remedies include reinstatement, back pay, compensatory damages, and attorney fees.
Tennessee Public Protection Act (TPPA)
Protects employees from retaliatory discharge for refusing to participate in or for reporting illegal activities by their employer. The TPPA requires the employee to have complained to the employer about the illegal conduct in writing before being protected — an important procedural prerequisite that distinguishes Tennessee from states with broader whistleblower protections. Employees must bring TPPA claims within one year.
Tennessee Workers' Compensation Act
Requires employers with five or more employees to maintain workers' compensation insurance or qualify as self-insured. Benefits include all medical expenses, temporary total disability at 66-2/3% of average weekly wages (with state caps), permanent partial and total disability awards, and death benefits. The Tennessee Court of Workers' Compensation Claims adjudicates disputed claims. Retaliation for workers' compensation activity is prohibited under Tenn. Code § 50-6-114.
