  • Public policy exception: Rhode Island courts recognize wrongful discharge claims when a termination violates a clear and well-established public policy of the state. Recognized grounds include retaliating against employees for filing workers' compensation claims, for jury duty service, for whistleblowing under the Rhode Island Whistleblowers' Protection Act (R.I. Gen. Laws § 28-50-1), and for exercising rights under Rhode Island labor statutes. The exception requires a specific statutory or constitutional basis.
  • Implied contract exception: Rhode Island courts have recognized implied employment contracts arising from specific language in employee handbooks or oral representations by supervisors. Courts examine whether the employer's representations, viewed objectively, would lead a reasonable employee to believe they had a job security guarantee beyond the at-will default. Clear and conspicuous at-will disclaimers and signed acknowledgments protect employers from implied contract claims.

Minimum Wage

$14.00/hr (eff. 2023-01-01)

Rhode Island minimum wage is $14.00 per hour effective January 1, 2023, with scheduled increases to $15.00 per hour on January 1, 2025 under H 5855A (2021). Rates adjust by CPI beginning in 2026. A tipped minimum wage applies: employers may pay tipped employees $3.89 per hour if total hourly compensation including tips equals at least $14.00 per hour (increasing to $3.89 upon the $15 floor increase).

R.I. Gen. Laws § 28-12-3

Rhode Island Minimum Wage Act

Establishes the statewide minimum wage with scheduled increases. The Rhode Island Department of Labor and Training (RIDLT) enforces violations; employees may recover unpaid wages plus equal liquidated damages and attorney fees in civil actions within three years. Employers must post the current wage notice and maintain payroll records for three years. Annual CPI adjustments begin in 2026.

R.I. Gen. Laws § 28-57-3

Healthy and Safe Families and Workplaces Act

Requires employers with 18+ employees to provide paid sick and safe leave accruing at 1 hour per 35 hours worked, up to 40 hours annually. Employers with fewer than 18 employees must provide unpaid sick time under the same accrual schedule. The RIDLT enforces violations; retaliation against employees who use or request leave carries civil penalties and employee remedies of reinstatement, back pay, and compensatory damages.

R.I. Gen. Laws § 28-5-7

Rhode Island Fair Employment Practices Act (FEPA)

Prohibits employment discrimination based on race, color, religion, sex, sexual orientation, gender identity or expression, age (40+), disability, national origin, country of ancestral origin, military or veteran status, pregnancy, and genetic information. Applies to employers with 4 or more employees. The Rhode Island Commission for Human Rights (RICHR) processes complaints; employees must file within one year. Remedies include reinstatement, back pay, compensatory damages, and attorney fees.

R.I. Gen. Laws § 28-14-3

Payment of Wages Act

Requires wages to be paid at regular intervals. Final wages for separated employees must be paid no later than the next regular payday. Employers who fail to timely pay wages face a civil penalty of 2x the unpaid wages as liquidated damages, plus attorney fees. Private civil actions within three years or RIDLT administrative complaints are both available enforcement options. The RIDLT may assess civil fines for non-compliance.
