  • Public policy exception: North Dakota recognizes a limited common law exception to at-will employment for terminations that violate a clear public policy articulated in state statutes or the North Dakota Constitution. Courts have recognized the exception for retaliatory discharge based on workers' compensation claims and jury service, but otherwise apply it very narrowly. North Dakota is considered one of the most employer-friendly states in the country with respect to at-will termination.
  • Implied contract exception: North Dakota courts are reluctant to find implied employment contracts from handbook language alone. The language must be very specific — explicit promises of "good cause" requirements or detailed termination procedures — to overcome the at-will presumption. General descriptions of progressive discipline are typically insufficient. Employers should use conspicuous at-will disclaimers and signed acknowledgments.

Minimum Wage

$7.25/hr (eff. 2009-07-24)

North Dakota minimum wage is $7.25 per hour, equal to the federal floor. North Dakota does not have a state-specific minimum wage statute separate from the federal FLSA; state law references the federal rate. Local governments may not enact higher minimum wages. A tip credit of $4.86 per hour applies; tipped employees must receive at least $2.39 per hour, with total compensation equaling $7.25.

N.D. Cent. Code § 34-06-22

North Dakota Minimum Wage Law

Incorporates the federal minimum wage standard. The North Dakota Department of Labor investigates wage complaints; employees may recover unpaid wages plus equal liquidated damages in civil court. Employers must maintain accurate payroll records and post current wage rate information. The tip credit allows tipped employees to receive a reduced cash wage as long as total compensation reaches the minimum wage standard.

N.D. Cent. Code § 14-02.4-03

North Dakota Human Rights Act

Prohibits employment discrimination based on race, color, religion, sex, national origin, age (40+), physical or mental disability, marital status, and status with regard to public assistance. Applies to employers with one or more employees. The North Dakota Department of Labor and Human Rights processes complaints; employees must file within 300 days. Remedies include reinstatement, back pay, compensatory damages, and attorney fees.

North Dakota Wage Payment

Requires wages to be paid at regular intervals. Final wages for separated employees must be paid on the next regular payday. The North Dakota Department of Labor investigates wage payment complaints and may order payment of unpaid wages. Employees may also bring civil actions within three years to recover unpaid wages, civil penalties, and attorney fees. Willful withholding of wages may result in misdemeanor criminal charges.

North Dakota Workers' Compensation

North Dakota has a unique state monopoly workers' compensation system — private insurance is not permitted. All employers must participate in Workforce Safety and Insurance (WSI), the state-run workers' compensation program. Benefits include medical treatment, partial wage replacement, permanent disability ratings, and death benefits. Employers who fail to participate face personal liability for injured workers' claims and criminal penalties. WSI administers all claims.
