  • Retaliatory discharge exception: New Mexico courts recognize a tort cause of action for wrongful discharge when an employer terminates an employee for reasons that contravene a clearly established public policy expressed in the New Mexico Constitution, statutes, or judicial decisions. New Mexico courts have consistently applied this exception to retaliatory discharges for filing workers' compensation claims, for whistleblowing, and for exercising other statutory rights.
  • Implied contract exception: New Mexico recognizes implied employment contracts arising from specific language in employee handbooks, personnel manuals, or oral representations by supervisors. Courts examine whether the employer's communications, taken as a whole, would lead a reasonable employee to believe they had job security beyond the at-will default. At-will disclaimers in handbooks are effective but must be conspicuous and unambiguous.

New Mexico minimum wage is $12.00 per hour statewide. Albuquerque, Santa Fe, and other municipalities have enacted higher local minimum wages. Santa Fe's minimum was $14.60 in 2024; Albuquerque's was $12.00 plus CPI adjustments. Employers must apply the highest applicable rate. Tipped employees: employers may count up to $3.00 per hour in tips toward the minimum wage if tipped employees earn at least $12.00 total.

NMSA § 50-4-22

New Mexico Minimum Wage Act

Sets the statewide minimum wage; local governments may set higher rates. The New Mexico Department of Workforce Solutions (DWS) enforces violations; employees may recover unpaid wages plus equal liquidated damages in civil actions within three years. Employers must post the current minimum wage notice and maintain payroll records for three years. Tipped employees receive a minimum cash wage with a $3.00/hour tip credit toward the full minimum wage.

NMSA § 50-10-1

New Mexico Healthy Workplaces Act

Requires all employers to provide paid sick and safe leave accruing at 1 hour per 30 hours worked, up to 64 hours (8 days) annually — one of the nation's most generous caps. Effective June 2022 for all employers of any size. The DWS enforces violations; retaliation against employees who use or request leave carries civil penalties of $500 per violation plus reinstatement and back pay. Employers must provide notice at hire and post the official DWS notice.

NMSA § 28-1-7

New Mexico Human Rights Act

Prohibits employment discrimination based on race, age (40+), religion, color, national origin, ancestry, sex, sexual orientation, gender identity, spousal affiliation, and physical and mental disability. Applies to employers with four or more employees. The New Mexico Human Rights Bureau investigates complaints; employees must file within 300 days of the discriminatory act. Remedies include reinstatement, back pay, compensatory damages, and attorney fees.

NMSA § 50-4-3

New Mexico Wage Payment Act

Requires wages to be paid at regular intervals not exceeding 16 days. Final wages for separated employees must be paid within five days of separation or on the next regular payday — whichever is earlier. Employers who fail to pay face a civil penalty of 5% of unpaid wages per day, up to a total of the unpaid amount. Private civil actions may recover unpaid wages plus the penalty, attorney fees, and court costs within three years.
