  • Public policy exception: Minnesota recognizes wrongful discharge claims when a termination violates an established public policy found in the Minnesota Constitution, statutes, or judicial decisions. Examples include retaliating against employees for filing workers' compensation claims, for serving on jury duty, for exercising rights under the Minnesota Human Rights Act, or for reporting violations of law. Courts require a specific statutory or constitutional basis for the public policy exception.
  • Promissory estoppel / implied contract: Under Pine River State Bank v. Mettille (1983), Minnesota courts recognize that handbook language creating a specific promise of job security or a defined termination procedure can constitute an offer of unilateral contract, accepted by the employee's continued performance. To avoid this, employers must include clear and conspicuous disclaimers stating that the handbook does not create a contract of employment.

Minimum Wage

$10.85/hr (eff. 2024-01-01)

Minnesota minimum wage: large employers (annual revenues of $500,000+) must pay $10.85 per hour; small employers pay $8.85 per hour. Rates adjust annually on January 1 based on CPI under 2014 legislation. Minneapolis and St. Paul have higher local minimum wages (Minneapolis: $15.57+ for large employers in 2026; St. Paul: phased toward $15). Employers must apply the highest applicable rate.

Minn. Stat. § 177.24

Minnesota Minimum Wage Act

Establishes a two-tier minimum wage structure: large employers (annual revenues ≥ $500,000) pay the higher rate; small employers pay less. Rates adjust annually on January 1 based on CPI. The Minnesota Department of Labor and Industry (DLI) enforces violations; employees may recover unpaid wages plus equal liquidated damages and attorney fees in civil actions within three years. Employers must post the current wage notice and maintain payroll records for three years.

Minn. Stat. § 181.9413

Earned Sick and Safe Leave (ESSL)

Requires all Minnesota employers to provide paid sick and safe leave beginning January 1, 2024. Accrual: 1 hour per 30 hours worked, up to 48 hours (6 days) per year for employers of all sizes. Employees may use leave after 90 days of employment. The Minnesota DLI enforces violations; unlawful retaliation against employees who use or request leave is subject to civil fines of $1,000 to $10,000 per violation, plus reinstatement and back pay.

Minn. Stat. § 363A.08

Minnesota Human Rights Act (MHRA)

Prohibits employment discrimination based on race, color, creed, religion, national origin, sex, marital status, familial status, disability, age (18+), sexual orientation, gender identity, and genetic information. Applies to employers with one or more employees. The Minnesota Department of Human Rights (MDHR) investigates charges; employees must file within one year of the discriminatory act. Remedies include reinstatement, back pay, compensatory and punitive damages, and attorney fees.

Minn. Stat. § 181.101

Minnesota Wage Payment Act

Requires wages to be paid at regular intervals not exceeding 31 days. Final wages for separated employees must be paid on the next regular payday. If the employer fails to pay within 24 hours of written demand, a penalty accrues equal to the employee's average daily wages for each day the wages remain unpaid, up to 15 days. Private civil actions may recover unpaid wages, the daily penalty, and attorney fees within three years.
