Key Iowa Employment Statutes
Iowa Minimum Wage Act
Sets the statewide minimum wage at the federal floor and expressly preempts local governments from enacting higher minimum wage ordinances. Exempt categories include agricultural workers and certain student employees. The Iowa Division of Labor investigates wage complaints; employees may recover unpaid wages plus equal liquidated damages in civil court. Willful violations can result in criminal charges under Iowa Code § 91D.4.
Iowa Civil Rights Act
Prohibits employment discrimination based on race, color, religion, sex, national origin, age, disability, sexual orientation, and gender identity. Applies to employers with four or more employees. The Iowa Civil Rights Commission (ICRC) investigates complaints; employees must file within 300 days of the discriminatory act. Upon finding probable cause, the ICRC may attempt conciliation or refer the case to the Attorney General. Remedies include reinstatement, back pay, compensatory damages, and attorney fees.
Iowa Wage Payment Collection Law
Governs the timing of wage payments, requiring at least semi-monthly paydays. Employers who discharge employees must pay all earned wages on the next regular payday; voluntary resignations follow the same schedule. Employers who withhold wages without justification face civil penalties of 5% of unpaid wages per day (up to a 30-day maximum). Private civil actions may recover unpaid wages plus the daily penalty amount, court costs, and attorney fees.
Iowa Workers' Compensation Act
Requires Iowa employers with one or more employees to carry workers' compensation insurance or qualify as self-insured. Provides the exclusive remedy for work-related injuries and occupational diseases. Benefits include 100% of reasonable medical expenses, 80% of the worker's spendable earnings during temporary disability, permanent impairment awards, and death benefits. The Iowa Workers' Compensation Commissioner adjudicates disputed claims.
