- Public policy exception: Idaho courts recognize a narrow tort claim for wrongful discharge when an employer terminates an employee in violation of public policy clearly expressed in the Idaho Constitution, state statutes, or judicial decisions. Examples include discharging an employee for exercising the right to file a workers' compensation claim (Idaho Code § 72-209) or for jury service. The exception does not extend to generalized notions of good faith and fair dealing.
- Implied contract exception: Under Idaho Code § 44-101, employment for an indefinite term is at-will and may be terminated by either party without cause. However, specific written promises of job security in an employee handbook, policy manual, or offer letter can create an implied contract. Idaho employers should include clear and conspicuous at-will disclaimers in all employment documents and obtain written acknowledgments from employees.

Idaho minimum wage is $7.25 per hour, matching the federal floor. Idaho has no mechanism for local governments to enact higher wages. There is no scheduled increase. The Idaho Department of Labor enforces wage claims. Idaho allows a tip credit: tipped employees may be paid as little as $3.35 per hour if their tips bring total hourly compensation to at least $7.25.

Key Idaho Employment Statutes
Idaho Minimum Wage Law
Establishes the statewide minimum wage at the federal floor. Exemptions include agricultural workers, certain summer camp employees, and employees in seasonal amusement. The Idaho Department of Labor investigates wage complaints; employees may recover unpaid wages plus an equal amount in liquidated damages in civil court. Three-year statute of limitations applies. Criminal penalties apply to willful violations by employers who repeatedly fail to pay minimum wages.
Idaho Human Rights Act
Prohibits discrimination in employment based on race, color, religion, sex, national origin, age (40+), and disability. Applies to employers with five or more employees. The Idaho Human Rights Commission (IHRC) investigates complaints; employees must file within one year of the discriminatory act — longer than most states. The IHRC may attempt conciliation; if unsuccessful, the complainant may request a right-to-sue letter. Remedies include reinstatement, back pay, and compensatory damages.
Idaho Wage Claims Law
Governs the payment of wages, requiring that wages be paid at regular intervals not exceeding 15 days. Final wages for discharged employees must be paid on the next regular payday or within 10 days of separation, whichever is earlier. Employers who fail to pay wages face a civil penalty of 5% of the unpaid amount per day for 30 days after the due date. Private civil actions may recover unpaid wages plus the penalty amount, court costs, and attorney fees.
Idaho Non-Compete Agreements
Idaho enacted the Trade Secrets Act and in 2016 amended its non-compete statute (Idaho Code § 44-2104) to make it easier for employers to enforce non-competes against "key employees" and "key independent contractors." Non-competes must be in writing, supported by adequate consideration, and reasonably limited in scope and duration. Courts apply blue-penciling to reform overbroad provisions. Idaho is considered employer-friendly in non-compete enforcement compared to most western states.
